AGA and Hussein Faraj v Fairfax: public court record

Published rulings concerning Advantage Group Australasia, Hussein Faraj, Fairfax Media Publications and The Sydney Morning Herald, with each procedural result linked to the official decision.

What the published rulings show

A procedural ruling decides how a claim can proceed at that stage. It does not, by itself, establish whether a disputed allegation is true, whether a publication was defamatory, or the final result of a case. The decisions below should be read in full; later orders or a final judgment may change the position.

  1. 6 March 2026: AGA v Fairfax [2026] NSWSC 164 (NSW Supreme Court, pleading ruling)

The Court struck out AGA’s injurious falsehood pleading, refused leave to rely on its proposed replacement, gave leave to replead, and ordered AGA to pay Fairfax’s costs of the application. It did not decide whether the reporting was true or false.

  2. 27 March 2026: Faraj v Fairfax [2026] NSWSC 388 (NSW Supreme Court, pleading ruling)

The Court allowed some proposed defamatory meanings to remain, struck out or required changes to others, and directed Mr Faraj to file a further amended claim. The ruling concerned pleadings, not whether the underlying allegations were true.

  3. 7 May 2026: Faraj v Fairfax and McClymont [2026] NSWCATAD 135 (NCAT, summary dismissal application)

NCAT dismissed the respondents’ application to summarily dismiss Mr Faraj’s racial and religious vilification complaint and listed the matter for directions. It made no finding that vilification occurred; that question was left for a substantive hearing.

  4. 19 June 2026: Faraj v Fairfax (No 2) [2026] NSWSC 747 (NSW Supreme Court, further pleading ruling)

The Court disallowed a proposed meaning about NuCoin, directed a further amended claim and a defence, and ordered Mr Faraj to pay Fairfax’s costs of the motion. It did not determine the final defamation claim.

How we report further events

We identify party allegations as allegations, distinguish interlocutory orders from final judgments, and link to the underlying official decision wherever available. A new court event will be added with its date and source after the relevant record is checked.
